A Court Attendance Notice (CAN) is a formal document outlining criminal charges against you and stating the date of your proceedings. Missing this event is extremely serious and may result in a warrant for the individual’s arrest and additional charges. A summary offence refers to a criminal charge carrying a maximum penalty of no more than two years, which can only be dealt with in the Local Court. In contrast, an indictable offence is a criminal charge which carries a maximum penalty of more than 2 years imprisonment. A significant number of indictable offences can and are routinely heard in the Local Court.

An indictable offence is therefore more serious than a summary offence, and whilst there is a time limit in that the prosecution cannot proceed with a summary offence if the alleged offence occurred more than 6 months ago, there is no such time limit attached to an indictable offence You can determine the severity of your criminal charge by contacting the team at Repute Law today.

A “quashed” conviction refers to a conviction that the Court of Criminal Appeal has invalidated or overturned, while a “pardon” is not the equivalent of an acquittal, it clears a person from all consequences of the offence but does not eliminate the conviction itself. 

Regarding convictions in NSW, a typical conviction becomes a “spent conviction” if an adult person maintains a clean criminal record for 10 years from the date of the conviction. For a child, it is 3 consecutive years.. However, there are some specific convictions that do not fall under this category. These exceptions encompass: 

  • Cases where a prison sentence exceeding six months has been imposed (periodic or home detention does not qualify as a prison sentence).
  • Convictions against corporate entities and other corporate bodies.
  • Sexual offences
  • Convictions specified by the Regulations.
