FAQs

If charged with speeding, the prosecution must prove, beyond a reasonable doubt, that you were travelling above the speed limit as alleged. This may involve reliance on a police officer’s estimate of your speed without any equipment or by way of a speed camera.

A Police estimate of speed can be challenged by assessing any deficiencies in the calculation method. Challenging a speed camera is more difficult.

If a Court convicts you of speeding, you can expect to receive a financial penalty, demerit points, and if it is alleged your speed was over 30 km/h above the speed limit, licence suspension.

The amount of your fine will vary depending on many factors, including:

  • The state in which you reside
  • How many kilometres over the legal limit you were
  • Whether you drive a lightweight or heavyweight vehicle
  • The type of licence you held
  • Whether double demerit points apply
  • Whether the case is dealt with by a penalty or in Court

If charged with a speeding offence, our speeding offence lawyers at Repute Law will help by taking one of the following measures:

  • Ask the Court not to impose a conviction and deal with the matter by Section 10 of the Crimes (Sentencing Procedure) Act 1999 to prevent you from being convicted and losing demerit points.
  • Plead not guilty and persuade the Court the Police have not proven their case beyond a reasonable doubt.
  • Plead guilty to the charges but dispute the facts at a “Disputed Facts” hearing for a less harsh sentence.
