The serious impact of your charge

The penalties for police pursuit offences are severe. You could lose your licence and even be sent to prison if convicted. The maximum penalty for police pursuit is three years in jail for a first offence or five years in jail if you have been convicted of another major offence in the five years immediately before. If convicted, there is an automatic licence disqualification period of 3 years with a minimum period of 12 months. Loss of licence and a criminal record can affect your job and career prospects. If you are charged with a police pursuit offence, you must seek legal advice early so someone can advocate for you and maximise the chances of a positive outcome.

The last thing you want is to appear in Court unprepared when charged with a serious crime. You must understand your rights and the legal proceedings in the Courtroom. When the stakes are high, we strongly recommend seeking representation in Court from our police pursuit defence lawyers.

FAQs

A police pursuit is a chase by law enforcement officers to apprehend a vehicle. Police often use sirens, lights and marked or unmarked vehicles to signal the suspect to stop.

Police pursuits can be dangerous and involve fast speeds and evasive manoeuvres, raising concerns about public safety and the legal and ethical aspects of the pursuit tactics.

In a police pursuit case, the prosecution must prove beyond reasonable doubt that you knew, or ought to reasonably have known, the police were in pursuit of your vehicle, and you must stop. If you do not stop after you realise the police are in pursuit, the prosecution must prove you then drove the vehicle recklessly, at a dangerous speed or in a manner dangerous to others.

The maximum penalty, if charged as guilty for police pursuit, is imprisonment for three years for first-time offenders or five years for second or subsequent-time offenders. There is also an automatic disqualification period of three years, with a minimum of one year. If not convicted, no order needs to be made against your licence.

To contest a police pursuit charge, start by consulting with one of our police pursuit defence lawyers, who will work closely with you to gather all relevant evidence, including witness statements, surveillance footage and police reports, to help build a strong defence. You must attend all Court appearances and allow our police pursuit defence lawyer to advocate on your behalf.

There are also technical legal defences that your Senior Lawyer from Repute Law will consider when analysing the case against you.

At Repute Law, our police pursuit defence lawyers will work closely with you to protect your rights and interests and help you get the best outcome in your case. We provide clients with the personalised advice and support they need during this challenging time.
